Terms of service.

1. Agreement to Terms

By accessing or using this website (stainandsteel.com) and placing orders with Stain and Steel (“we”, “us”, “our”), you (“you”, “Client”, “Customer”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, do not use the Site or commission work.

2. Definitions

“Commission” — any custom artwork or project we produce for you.
“Deliverables” — the finished artwork, files, or physical goods delivered.
“User Content” — any content you provide (images, text, instructions, designs).
“Site Content” — content we provide on the website (images, text, portfolio, blog).

3. Services & Orders

You may submit a Commission request via our site, email, or consultation.
We will issue a quote that includes design, production, finishing, shipping, and extras.
Work begins only after you accept the quote and pay the required deposit. Revisions or changes beyond the agreed scope may incur additional charges.

4. Payment Terms & Refunds

Deposit: 50% of the quoted price is due before work begins.
Final Payment: The remaining 50% is due before shipment or delivery.
Refunds / Cancellations:
• If you cancel after deposit but before major work begins, a partial refund may apply (less a 15% administrative fee).
• After final approval, no refunds.
• Mid-project change requests are extra cost.

5. Intellectual Property & Usage

All rights (copyright, design files, meshes, photographs) remain with Stain and Steel unless otherwise agreed in writing.
You receive a nonexclusive license to display the completed art for personal, noncommercial use. You may not reproduce, redistribute, modify, or sell the Deliverables without written permission.

6. Client Obligations & Cooperation

You must supply clear instructions, reference materials, dimensions, and timely feedback. Delays may shift the timeline.
You guarantee your User Content does not infringe third-party rights.

7. Delivery, Shipping & Risk

You cover shipping, taxes, and import duties unless stated otherwise. Risk transfers to you once the item leaves our premises. We are not liable for carrier or customs delays or force majeure events.

8. Revisions & Acceptance

One revision round included (unless otherwise agreed). After deliverables are accepted (in writing or via final payment), additional edits are billable.

9. Warranties & Disclaimers

We warrant that deliverables meet agreed specifications and are defect-free for 14 days post delivery. All other warranties (including fitness for purpose, merchantability) are disclaimed. We are not liable for indirect or consequential damages.

10. Limitation of Liability

Our maximum liability for any claim is limited to the amount you paid for that Commission. We disclaim liability for losses beyond that (e.g. lost profits, data loss).

11. Indemnification

You agree to indemnify and hold harmless Stain and Steel, its agents, employees, and subcontractors from claims or costs arising from your breach of these Terms or your User Content.

12. Governing Law & Dispute Resolution

These Terms are governed by Alberta, Canada law. Disputes shall be resolved in Alberta courts unless otherwise agreed. Parties agree to attempt mediation before litigation.

13. Changes to Terms

We may update these Terms at any time. Updated Terms take effect when posted. We’ll notify you via email or site notice. Continued use after updates means you accept them.

14. Severability & Entire Agreement

If any clause is invalid, the remainder remains valid. These Terms (plus our Privacy Policy) represent the entire agreement between us.
